The Peshawar High Court (PHC) has released the written order from the previous hearing on petitions challenging the suspension of Senate elections, while demanding responses from the Election Commission of Pakistan (ECP) and all other parties involved.
A two-member bench, headed by Justice Syed Arshad Ali, heard the petitions filed by Provincial Assembly Speaker and Senate candidate Irfan Salim against the postponement of the elections.
During the proceedings, petitioner’s counsel Ali Gohar Durani, Additional Attorney General Taimur Haider, and respondent’s counsel Barrister Yasin Raza appeared before the court.
The court directed the Election Commission and the opposing party, Provincial Assembly member Jalal Khan, to submit written responses by the next hearing.
The petitioner’s lawyer argued that despite the Election Commission having issued a schedule once, it proceeded to postpone the elections, whereas under Article 224 of the Constitution, the Commission does not have the authority to suspend elections.
On the other side, the respondent’s counsel contended that the Election Commission is a constitutional forum vested with full authority, and until the Commission reaches a final decision, other courts should not interfere in its jurisdiction.Latest News, Breaking News & Top News Stories | The Express TribuneYasir AliRead More
